Information You Provide Directly

• Financial information for transactions (processed through PCI-compliant third-party providers; we do not store card or bank numbers directly)

• Submitted imagery (personal information within images is subject to applicable licensing agreements)
• Claim imagery and visual materials (e.g., photos or videos that you take on your mobile device through our app or platform) submitted in connection with property insurance claims or damage assessments, along with related metadata
• Location-based data from mobile devices, where permitted

When you use our services, we may also collect:

• Mobile device specifications (device ID, camera, storage, GPS, and sensor data)

• Session and interaction data, such as pages or screens viewed, unredacted screen capture images of your session while using or interacting with certain components of our app or platform, features used, clicks, scrolling activity, navigation paths, session activity, and related usage interactions

Cookies and Tracking

Where appropriate, we mask sensitive information. We may also use these technologies to document and improve the claim submission process.

Social media plugins may transmit your IP address and profile information to social networks, even if you are not logged in to those services.

How We Use Your Information

• Determine if claim imagery or visual materials that you have submitted in connection with property insurance claims or damage assessments, along with related metadata, are sufficient to document property condition and visible damage, generate measurements or damage-related outputs, support claim review and estimating, and maintain audit records of claim documentation

We (including our individual staff members) will not use your information beyond the minimum amount and scope necessary to achieve the above purposes without first obtaining your consent.

To the extent permitted under applicable law, we may also create statistical, de-identified, anonymized, or aggregated data (collectively, “Aggregated Data”) relating to our users and our app or platform to use for analytical, research, or any other legal purposes. Aggregated Data includes data derived from your Information and data that we collect from other sources that has been anonymized so that it does not relate to and could not reasonably be used to identify any individual.

If you provide us with your email address, we may in the future begin to send you administrative or promotional emails, including newsletters or updates regarding our products and services. If you wish to opt out of any such emails, you may do so by following the “unsubscribe” instructions in the email.

Sharing Your Information

Elara Spatial will not share, rent, sell, or otherwise disclose any information we collect about you, except when we have your permission or in the following circumstances:

• When you have consented to us sharing or disclosing your information.
• When the information is shared with or disclosed to a parent company, subsidiary, joint venture, or other entity under common control with us in order to achieve any of the uses or purposes described in this privacy policy.
• Subject to the terms of a confidentiality agreement, in connection with, and for the purposes of, a business deal (or negotiation of a business deal) involving the sale or transfer of all or a part of our business or assets. These deals may include any merger, financing, acquisition, or bankruptcy proceeding.
• With a third-party contractor engaged to provide management, administrative, data collection, marketing, or other support services on our behalf (a “Contractor”), which require the Contractor to have access to any information we collect under this privacy policy. In this instance, we generally enter an agreement with the Contractor limiting their use of the information to the minimum amount necessary to perform the services for which we have engaged them; requiring the Contractor to report any suspected or actual breach of security or other incident related to the information to us; and requiring the Contractor to adhere to the same level of privacy requirements that are required of us by all applicable law. By accessing or using our app or platform, you consent to our sharing your information with any Contractors and to the Contractors’ use of your information in accordance with all applicable law, this privacy policy, and the other terms and conditions applicable to our app or platform.
• With insurance carriers, adjusters, claim administrators, service providers, analytics providers, and other vendors that help us provide, support, review, process, or improve claim-related services (this may include disclosure of claim imagery, room views, session activity, and related metadata).
• To detect, prevent, or otherwise address security, fraud, or technical issues.
• To ensure the personal safety of any individual, including our staff members or job applicants, app or platform users, or members of the public.
• To the extent required to comply with legal obligations, processes, or requests; enforce our policies, contracts, and agreements (including this privacy policy); or protect or defend our legal rights.

To the extent permitted by applicable law, we may in our sole discretion disclose any Aggregated Data that does not contain identifiable information to any third-parties for any legal purpose.

Use of our app or platform may involve the use of third-party search engine operators or telecommunications carriers. These operators are not our Contractors, and any information that these operators collect in connection with your use of our app or platform is not a part of our collected information and is not subject to this privacy policy. We are not responsible for the acts or omissions of these operators.

California Residents

We do not currently honor Do Not Track signals. California residents with an established business relationship may request that we not disclose personal information to third parties for direct marketing purposes.

Security

To the extent required by applicable law, we utilize appropriate, commercially reasonable physical, electronic, and managerial procedures and security precautions — including, but not limited to, the implementation of encryption technology — to protect your data. However, no data transmission over the Internet or encryption method can be guaranteed to be 100% secure. We are not responsible for the actions of hackers and other unauthorized third-parties that breach our reasonable security procedures.

Additionally, to the extent that your use of our app or platform requires you to create an account and password, you are solely responsible for maintaining the secrecy of this login information. This privacy policy is not intended to confer, nor does it confer, any rights or remedies to users.

Further, where feasible, we use masking or access controls to limit unnecessary collection of personal information. Automated systems may process images before personal information is removed for quality-control purposes; no human reviews unredacted imagery.

Data Retention

Unless you ask us to delete your information sooner, we will maintain it until such time that we determine, in our sole discretion, that (1) it is no longer necessary for any purpose for which we may use it in accordance with this privacy policy; and (2) it may be destroyed or deleted in accordance with applicable law.

Children

Our services are not intended for users under the age of 13. If we learn that we have collected personal information from a user younger than 13, we will endeavor to delete that information promptly.

Your Rights

If you would like your information to be permanently removed from our database, please contact us using the email address listed at the bottom of this privacy policy. We may ask you to provide a copy of your driver’s license or other identifying documents to assist us in processing your request. We may still contact individuals who have requested that their information be permanently removed for administrative purposes. The removal of your information may take some time to complete and may be subject to certain restrictions, consistent with applicable law. Please also note that the removal of any information will not necessarily result in the removal of records of past transactions or the deletion of information stored in our data archives. Aggregated Data is not subject to requests for removal.

We will, to the best of our ability and in accordance with applicable law, allow you to access, review, correct, or add to your Information held in our database. To make any such request, please contact us using the email address listed at the bottom of this privacy policy. We will make our best efforts to process your request promptly once we receive it. Please note that we may ask you certain follow-up questions prior to processing your request to confirm your identity and the specific information that is the subject of your request, in accordance with applicable law.

Third-Party Sites

Our app and platform may contain links to other websites, cookies, or other materials from, or which may be operated by, third-party entities. The information practices and privacy policies of these third-party entities may be different than those of our own. We are not responsible for any actions or omissions by any such third-party entities. This privacy policy applies only to information that we collect.

Governing Law and Location

Elara Spatial is located in and operates under U.S. law. By using our services, you consent to the transfer of your data to U.S. servers. Those who choose to access our app or platform do so on their own initiative and at their own risk, and are responsible for complying with all local laws, rules, and regulations.

We may limit our app’s or platform’s availability, in whole or in part, to any person, geographic area, or jurisdiction we choose, at any time and in our sole discretion. We do not represent or warrant that our app or platform, or any part thereof, is appropriate or available for use in any other jurisdiction. If you choose to access or use our app or platform, you consent to the use and disclosure of information in accordance with this privacy policy and subject to all applicable laws.
